1 About these Terms
These Terms of Use apply to online courses, training packages, recorded workshops, videos, presentations, downloads, screening tools, activity ideas and associated educational materials supplied by Children's Therapy Services Queensland (CTSQ, we, us or our).
The description on the relevant course or sales page forms part of these Terms. It will state the intended audience, subject matter, fee, access period, inclusions, prerequisites and whether a certificate is available.
2 Eligibility and registration
Purchasers and registered participants must be at least 18 years old. By registering, you confirm that the information you provide is complete and accurate and that you are legally able to enter into this agreement.
Unless we approve a transfer in writing, enrolment is personal to the named participant and cannot be transferred to another person.
3 Educational and professional disclaimer
Our training provides general education and professional development information for parents, carers, educators, support workers, therapists and other professionals supporting children and families.
Unless the course description expressly says otherwise, completing a course:
· Does not provide a formal qualification, professional registration, accreditation or licence;
· Does not authorise you to work outside your existing qualifications, competence or professional scope;
· Does not replace individual medical, psychological, allied health, therapeutic or educational assessment;
· Does not establish a therapist-client, clinician-patient or supervisory relationship with CTSQ or a presenter; and
· Does not guarantee recognition or continuing professional development points from an employer, registration body or professional association.
Participants remain responsible for their professional judgement and for complying with relevant laws, codes of conduct, professional standards, safeguarding duties and organisational policies.
4 Using activities with children
Some courses provide activities or practical ideas that may be used with children. Before using an activity, you are responsible for considering the child's age, abilities, developmental needs, health and individual circumstances.
· Provide appropriate adult supervision and check the environment and equipment for risks;
· Obtain any required parent, guardian, organisational or professional consent;
· Work within your qualifications and scope of practice; and
· Stop immediately if a child experiences pain, breathing difficulty, dizziness, distress, discomfort or another concerning response, and seek appropriate advice where required.
Outcomes vary between individuals. CTSQ does not guarantee a particular developmental, behavioural, therapeutic, educational or health result.
5 Course access
Access is provided for the period advertised on the relevant course page. The access period usually starts on the date of purchase or enrolment unless another commencement date is stated.
You are responsible for completing the course and downloading any permitted resources before access expires. Access will not automatically be extended because a participant did not start or complete the course within the advertised period. We may offer an extension at our discretion or for an additional fee.
If a course is to be permanently removed before the end of an advertised access period, we will normally provide at least 30 days' notice to the participant's registered email address and, where reasonably possible, an appropriate opportunity to complete the course or retain permitted resources. This does not limit rights available under the Australian Consumer Law.
6 Accounts and technology
You are responsible for maintaining the confidentiality of your login details, keeping your account information current and notifying us promptly if you believe your account has been accessed without permission.
You must have a suitable device, supported browser, reliable internet connection and any software identified in the course description. Some functions are provided through third-party platforms, including Thinkific, video-hosting services and payment processors. Those services may also have their own terms and privacy practices.
We may monitor course activity, including login activity, lesson progress, video engagement, assessment completion and document downloads, for course administration, certificate verification, platform security and investigation of suspected account sharing. Personal information is handled in accordance with our Privacy Policy and applicable privacy law.
7 Individual use licence and intellectual property
All intellectual property rights in the training and resources remain with CTSQ or the relevant presenter, author, photographer or licensor. Photos and videos are created by CTSQ or used with permission from their respective copyright holders.
A purchase provides one named participant with a limited, personal, non-exclusive, non-transferable and revocable licence to access the materials for their own learning. Unless a separate group or organisational licence has been agreed in writing, you must not:
· Share login details or allow another person to access the course through your account;
· Copy, reproduce, photograph, screen-record, publish, upload or redistribute course content;
· Place materials on a shared drive, website, social media account or another learning platform;
· Use the materials to train others or as part of another workshop, course or training event;
· Sell, license, rebrand, adapt or commercially exploit the materials; or
· Remove copyright notices, CTSQ branding or other ownership information.
Downloadable resources may only be reproduced for the participant's own use, or direct work with children and families where the resource expressly permits this. Schools, clinics and organisations must purchase the appropriate number of participant places or obtain a group licence.
8 Certificates
Where offered, a certificate is issued only after the named participant completes the full course and any stated requirements. A certificate confirms course completion only and does not represent professional registration, accreditation or competency unless expressly stated.
Certificates must not be altered or transferred. We may decline to issue or may withdraw a certificate obtained through false information, account sharing or failure to complete required course components.
9 Fees and promotions
Fees are displayed before purchase. Unless stated otherwise, prices are in Australian dollars and include GST where applicable. Payment must be completed using an available checkout method. Access may be withheld or suspended where payment is declined, reversed, disputed or outstanding.
Prices may vary because of promotions, discounts or special offers. A later price reduction does not entitle a previous purchaser to a refund or reimbursement of the difference. You are responsible for fees charged by your bank, card provider or currency-conversion service.
10 Cancellations and refunds
Australian Consumer Law: Nothing in these Terms excludes, restricts or modifies a consumer guarantee, right or remedy that cannot lawfully be excluded.
Please choose courses carefully. We do not provide a voluntary refund where a participant:
· Changes their mind or decides that the course is no longer required;
· Purchases the course in error;
· Does not start, access or complete the course within the advertised access period;
· Has started or completed the course, downloaded materials or received a certificate;
· Finds that the course is not recognised by an employer, professional association or registration body where recognition was not expressly advertised;
· Experiences a problem caused by their own device, internet connection or incompatible software; or
· Seeks a price adjustment because the course is later offered at a discounted price.
To request assistance, email [email protected] with your name, course, purchase date and details of the issue.
11 Course changes availability and cancellation by CTSQ
We may make reasonable updates to improve accuracy, quality, safety or relevance, including correcting errors or replacing resources. We will not intentionally make a change that materially reduces the course purchased without providing an appropriate alternative or remedy where required by law.
Access may occasionally be interrupted by maintenance, platform outages, security issues or events beyond our reasonable control. We will take reasonable steps to restore access or provide an appropriate alternative.
If CTSQ cancels a course and cannot provide substantially equivalent replacement access, we will offer an appropriate remedy, which may include transfer or refund, subject to the Australian Consumer Law.
12 Participant conduct and suspension
You must not use the training platform unlawfully, introduce harmful code, attempt unauthorised access, interfere with another participant, infringe privacy or intellectual property rights, or upload identifying or confidential information without appropriate authority.
If we reasonably suspect a breach, including account or material sharing, we may temporarily suspend access while we investigate. Where appropriate, we will explain the concern and provide a reasonable opportunity to respond or correct it. We may terminate access for a serious or repeated breach. Any refund decision remains subject to the Australian Consumer Law and the circumstances of the breach.
13 Privacy and confidentiality
We handle personal information in accordance with applicable privacy laws and our Privacy Policy. Participants must not submit identifying, sensitive or confidential information about a child, family, client or colleague unless this is necessary for an authorised course activity, they have lawful authority and appropriate consent, and an approved secure method is used.
Where case examples are permitted, information must be appropriately de-identified.
14 External resources
Courses may link to external websites, products, research or resources for convenience and educational purposes. Unless expressly stated, CTSQ does not control or endorse third-party services and is not responsible for their ongoing availability, accuracy, security, content or privacy practices.
15 Limitation of liability
Nothing in these Terms excludes, restricts or modifies a right or remedy that cannot legally be excluded, including rights under the Australian Consumer Law.
To the extent permitted by law, CTSQ is not responsible for indirect or consequential loss arising from reliance on general educational information as individual advice, activities implemented without appropriate assessment or supervision, use outside a participant's qualifications or scope, third-party services beyond our reasonable control, or failure to meet stated technology requirements.
16 Events beyond reasonable control
We are not responsible for delay or interruption caused by events beyond our reasonable control, including significant internet or platform failures, natural disasters, government restrictions, cyber incidents or illness affecting a scheduled presenter. Where such an event materially affects the training, we will take reasonable steps to provide replacement access, reschedule affected content or offer another appropriate remedy.
17 Changes to these Terms
We may update these Terms to reflect changes to our services, technology or legal obligations. The Terms accepted at the time of purchase will generally apply to that purchase. Updated Terms apply to subsequent purchases and continued use where legally permitted. The current version and effective date will be published on our training platform or website.
18 Governing law
These Terms are governed by the laws of Queensland, Australia. The parties submit to the courts and tribunals having jurisdiction in Queensland. This does not prevent a consumer from exercising rights available under applicable consumer-protection legislation.
